The issues, complexity and nuance of data protection and privacy compliance are expanding. Issues such as data breach, breach notifications, increasing penalties and fines, the new GDPR, record keeping requirements, etc., are but examples. Increasing conflict and ethical issues arise while the formalities of decisions and recording activities are set to become more detailed.

Yet, the person tasked with being the first responder and pre-problem solver in the organisation to data protection and privacy issues – whether the Data Protection Officer, Privacy Officer and or Privacy Counsel – is becoming more formal, more prescribed and more onerous.

Developing data protection issues need to be appraised from the specific Data Protection Officer, Privacy Officer and or Privacy Counsel focus. This is a specific perspective and is distinct from a general commentary, introduction or academic or professional perspective on overarching data protection and privacy issues. All of the GDPR, for example, may not be applicable to all Data Protection Officers, Privacy Officers and Privacy Counsel. Separately, certain aspects may be applicable on certain occasions but not others.

Frequently, the individual need and nuance of the Data Protection Officer, Privacy Officer and or Privacy Counsel in each individual sector are ignored. It is too often assumed that the individual DPO, etc., wants to know about the whole A-Z of particular issues or new laws, whereas certain issues and certain sections may be applicable and some may not. The issues facing a DPO, etc., in the medical sector may be quite different from those of a DPO, etc., in the retail sector. These respective sectors are also somewhat generic and can each be differentiated into many individual sub-sectors which will have their own nuances in dealing with data protection and privacy.
